Palmer v. Stassinos,
348 F. Supp. 2d 1070 (N.D. Cal. 2004)
The Law Office of Paul R. Stassinos in California participates
in a check collection business. Paul R. Stassinos claims to
have offices in Fair Oaks, Modesto and Bakersfield. We are
representing plaintiffs in class action lawsuits filed against
Paul R. Stassinos and other defendants for violating the Fair
Debt Collection Practices Act, and other laws.
In this lawsuit, the plaintiffs allege that the Law Office of
Paul R. Stassinos is violating the law in several ways. One
allegation is that the letters that appear to come from his
office are actually sent by other debt collector defendants,
who simply pay Paul R. Stassinos to use his name on the
letters, even though he is not meaningfully involved in each
of the letters that are sent. Another allegation is that the
Law Office of Paul R. Stassinos has asked for collection fees
to which it is not entitled.
The United States District Court in San Jose, California, has
ruled that the law does not permit the collection of
prejudgment interest on a dishonored check. The court has not
made any other rulings on the merits, and has not yet decided
whether either of the lawsuits will proceed as a class action.
By an act of the United States Congress, I
am a "debt
relief agent." The determination of the need for legal services, or
debt relief services, and the choice of a lawyer are extremely
important decisions and should not be based solely upon advertisements. Law changes from place to place and time
to time. This website is not and is not intended to be an
advertisement outside the state of California. This website is helpful, but is not meant to be legal advice.
Thus, it is not a substitute for meeting with an attorney and
obtaining specific legal advice. No
attorney client relationship has or will be established with Attorney
Ronald Wilcox unless and until a written retainer agreement has been
executed. Ronald Wilcox is admitted in California.
For the most part, this web site only discusses chapter 7 bankruptcy. When the word
"bankruptcy" is used in this web site, it is only referring to chapter
7 bankruptcy. There are other chapters of bankruptcy. These other
chapters may be better for you depending on your particular
circumstances. The chapter you choose to file has many consequences.
To determine which chapter is best in your situation, you should speak
with a qualified bankruptcy attorney.
